Records that matter

Start with: promissory note, disbursement records, servicer history, payment statements.

Questions that can change the analysis

Review: borrower/cosigner, ownership, payment history, default, settlement.

  • Who is the current plaintiff or collector?
  • What amount is claimed and how is it calculated?
  • Is there a lawsuit, judgment, garnishment, or levy already?
  • What settlement or dispute records already exist?

Connect the account to the court case

If a lawsuit is filed, use the complaint and exhibits to see which facts the plaintiff alleges. If the account was sold, ask what records connect the specific account to the current plaintiff. If no lawsuit is filed, keep collector communications and validation information separate from court procedure.

Official Sources to Check
