Records that matter

Start with: collector letters, validation notice, original account records, payment history.

Questions that can change the analysis

Review: who owns the debt, who is collecting, validation, communication conduct.

  • Who is the current plaintiff or collector?
  • What amount is claimed and how is it calculated?
  • Is there a lawsuit, judgment, garnishment, or levy already?
  • What settlement or dispute records already exist?

Connect the account to the court case

If a lawsuit is filed, use the complaint and exhibits to see which facts the plaintiff alleges. If the account was sold, ask what records connect the specific account to the current plaintiff. If no lawsuit is filed, keep collector communications and validation information separate from court procedure.
